REQUIREMENT FOR REGISTRATION OF INDUSTRIAL DESIGNS IN VIETNAM

1.   Order Letter containing the following information:

- Full name, registered address, and nationality of the applicant and creator

- Title of the design and field to which the design relates.

- Date, number of the earlier application, country and applicant, for claiming any convention priority.

- Place where the design was exhibited, the name of the exhibition and the date on which the design was first exhibited, for claiming exhibition priority

- International classification code under the Locarno Agreement.

2.  Power of Attorney from applicant(s) to AMBYS signed by applicant (if individual) or by an officer of company applicant whose name and position in the company should be stated.

General Power of Attorney is acceptable for filing various designs in the name of the same applicant(s).

3.   Seven (06) sets of drawings or photographs for every embodiment of the design, each set shall generally comprise of the following views: perspective, top, bottom, front, back, right, left. Size of photograph or drawing shall not be less than 9cm x 12 cm and not more than 21cm x 29 cm.

4.   If a design bears a sign that is inherently registrable as a trademark, the applicant shall provide with the documents, (e.g. copy of Trademark Registration Certificate granted by the NOIP or Trademark License Contract that has been registered with the NOIP), stating that the trademark placed on the design belongs to the applicant.

5.   Description of drawings (photographs) and of the industrial design in English indicating new, different features of the design comparing to known similar designs.

6.   Certified copy of the first filed application or Certificate issued by the competent authorities of the exhibition, where priority is claimed

Remarks:

1.  For obtaining the filing date, we need the information listed in paragraph (1) and documents Nos. (2), and (3) (their copies in fax form are also accepted at filing); The others, including the originals of the Nos. (2) and (3) shall be filed within a period of three (03) months from the filing date

2. Notarized Deed of Assignment from the creator(s) to the applicant(s), where the applicant is not the creator(s) or document justifying the right to apply (inheritance, employment contract, service contract) shall only be submitted under the NOIP's request and within one (01) month from the NOIP's request date.
