REQUIREMENTS FOR REGISTRATION OF INVENTION/UTILITY SOLUTIONS IN VIETNAM

 

 

I.       National Application.

1.   Order Letter containing the following information:

- Name, address, and nationality of the applicant and inventor.

- Title of the invention/utility solution.

- IPC of invention/utility solution.

- Date, number and country, applicant of the earlier application, for claiming priority.

- Place where the invention/utility solution was exhibited, the name of the exhibition, and the date on which the invention/utility solution was first exhibited, for claiming exhibition priority.

2.   Power of Attorney simply signed by applicant  (if individual) or by an authorized officer of company applicant whose name and position in the company should be clearly stated.

 

This document can be filed in the fax-copy form at the filing and the original shall be filed within 3 months from the filing date.

 

3.   A copy of description, claims, abstract in English and formal drawings (if any).  

 

4.   Certified copy of the priority document(s) and its (their) English translation(s) (if the language of priority documents is other than English) or Certificate issued by the competent authorities of the exhibition, where priority is claimed, filed within 03 months from the filing date of the application.

 

As Vietnamese translation of the documents 4 must be filed with the NOIP within 03 months from the filing date of the application, so the English translation of the document(s)  is (are) required to provide us within 02 months from the filing date.

 

5.  Notarized Deed of Assignment, where the applicant is not the inventor, need to be submitted only under the NOIP's request within one (01) month from the date of the request.

 

II. National Phase of PCT application.

 

PCT National Phase Entry within 31 months from the earliest priority date.

 

1.   Order Letter for Entry into National Phase, containing the following information:

- International application number and International filing date.

- Full name, address and nationality of applicant, inventor, assignee (if relevant, plus date of assignment).

- Title of invention.

- Data of application(s) from which priority(s) is (are) claimed

- A copy of English translation of the International application (description, claims, abstract, if any of those parts amended, both as originally filed and as amended) and a copy of drawings.

- IPC of invention/ utility solution

2.  Three copies of International Application and its English translation (if the International Application has been filed in the language other than English)  and the following documents:

          - A Copy of Request (Form PCT/RO/101).

          - A copy of International Search Report (if any).

          - A copy of Written Opinion (if any).

          - A copy of Demand (Form PCT/IPEA/401).

          - A copy of Information concerning Elected Offices notified of their Election (Form PCT/IB/332).

          - A copy of the International Preliminary Examination Report (Form PCT/IPEA/409).

          - A copy of amendment(s) under PCT Article 19 or 34 (if any).

          - Other related documents.

3.   Simply signed Power of Attorney should be filed within 34th month from the earliest priority date.
